Why Now Is The Best Time To Prepare Your Will
Most people I meet do not like to discuss the topic of making a Will. However, it is an important topic, and I will share when and why a person should make a Will. I will also share the straightforward process of making a Will with me.
The time to make a Will is now.
The reasons to make a Will vary for each person. People with a little or a lot of assets are not the only ones who need a Will. The following are some common reasons clients have come to me to make a Will:
- To appoint an executor: someone who carries out the wishes of the will-maker, an especially important job. Only someone who is capable, and you trust should be appointed. The executor does not have to be the beneficiary of your Will;
- To appoint a guardian: A family with a child(ren) requires a Will to ensure a guardian of their choice is appointed;
- You choose your beneficiary instead of the Wills, Estates and Succession Act (WESA): Individuals who die without a Will do not decide who gets their assets; instead the law lays out the person(s) who will be your beneficiary which may not be someone you want, especially if you do not have a spouse or dependents.
- Pets: to appoint a person of your choice to take care of your pet(s) and if you want, to also give that person a financial benefit;
- Specify funeral details: some people leave it to the executor to decide what kind of funeral they will have but others like to specify their wishes like if they want to be buried or cremated.
When someone calls my office to book an appointment for a Will, I will email them information and the type of questions I will be asking during our appointment. It is not necessary to review this information, but some people like to prepare for the questions ahead of time –such as who to name their executor and the backup to their first choice. I typically book two appointments, with the first appointment lasting about an hour and the second appointment about half an hour. In the first appointment, I gather all the client’s information and their wishes. We book a second appointment to confirm the details of the Will that I drafted, make changes if needed and sign the final Will. I am often told it was an easy, smooth process. The hardest part is making that effort to contact me -I assure you once you make that first contact, your Will is going to be done before you know it.
The time to make a Will is today. I have met people of all ages suddenly becoming ill and urgently needing surgery or other medical care.
